This Privacy Policy relates to information collected by Yodelay LLC (“Yodelay” "we" or “us” or “our”) through your use of the Yodelay website at yodelay.com and any subdomains thereof (the “Site”) and the services, features, and information available on the Site and/or any mobile applications we may offer (together with the Site, along with associated and successor websites, applications, features, information, and services, or any part thereof, the “Service”). This Privacy Policy is incorporated into, and part of, and governed by the
Yodelay Terms of Use. As used herein, “you” and “your” mean a user of the Service and in addition, when the user of the Service is a minor registered by a parent and/or guardian, the terms “you” and “your” also include such parent and/or guardian. You should carefully read this Privacy Policy. By using the Service or permitting your child to use the Service, you are signifying your acceptance of this Privacy Policy. Depending on your use of the Service, we may collect two types of information: personally identifiable information and non-personally identifiable information.
Personally Identifiable Information Personally identifiable information is information that identifies you or can be used to identify or contact you. Such information may include your name, e-mail address, cell phone number, IP address, birthdate, and geolocation information. Additionally, we may engage a third party service provider to provide billing and payment processing services (the “Payment Services Provider”), that may collect your billing and credit card information from you directly. In addition to the foregoing personally identifiable information, we may have access to personally identifiable information (i) which you at your option provide us, including information that you upload to the Service in connection with your use of the Service, such as photo(s), your account user name or handle, your contacts, your current geographic or GPS location, and any other information that you choose to share in posts or messages through the platform, (ii) which you provide to third parties in connection with the Service, including the Google Play Store and the Apple Store, and (iii) when you contact us for customer support assistance. Personally identifiable information amounts to ‘personal data’ for the purposes of and as defined in the GDPR. All references to personally identifiable information includes ‘personal data’ as defined and used in the GDPR (to the extent applicable). We may collect from you, or you may make available to us, some special categories of personal data. By agreeing to this Privacy Policy, you explicitly consent to the processing of any such special categories of personal data. “Special categories of personal data” consist of personal data for the purposes of and as defined in the GDPR which is to be treated with particular sensitivity, and includes information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic or biometric data, data concerning health or data concerning a person’s sex life or sexual orientation.
Non-Personally Identifiable InformationNon-personally identifiable information is information, any single item of which, by itself, cannot be used to identify or contact you, including non-identifiable demographic information, browser types, unique device identifiers, device types, requested URL, referring URL, browser language, the pages you view, the date and time of your visit, domain names, and statistical data involving the use of the Service. Certain non-personally identifiable information may be considered a part of your personally identifiable information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified. We will collect personally identifiable information that you submit to us. We may also receive personally identifiable information about you from third parties providing credit and debit card authorization and fraud screening services as part of your use of the Service.
Registering to Use the Service and in the Course of Using the Service.You may be required to establish an account in order to take advantage of certain features of the Service. Cookies and Action Tags.We may collect information passively using “cookies” and “action tags.”“Cookies” are small text files that can be placed on your computer or mobile device in order to identify your web browser and the activities of your computer on the Service and other websites. DOES YODELAY COLLECT INFORMATION FROM CHILDREN UNDER 13 YEARS OF AGE?
We are committed to protecting the privacy of children. The Service is not designed for or directed to children under the age of 13. We do not collect personally identifiable information from any person we actually know is under the age of 13.
WHAT DOES YODELAY DO WITH THE INFORMATION IT COLLECTS?
We will only use your personally identifiable information to the extent that the law allows us to do so. Laws and Legal Rights

Yodelay Terms of Use or another contract with us, to detect fraud, for assistance with a delinquent account, or to protect the safety and/or security of our users, the Service or the general public.
Third Parties Generally.
We provide to third parties non-personally identifiable information, including where such information is combined with similar information of other users of the Service. For example, we might inform third parties regarding the number of unique users who use the Service, the demographic breakdown of our users of the Service, or the products and/or services purchased using the Service and the vendors of such products and services. Outside Contractors.

In the course of providing products or services to us, these Outside Contractors may have access to information collected through the Service, including your personally identifiable information. We use reasonable efforts to ensure that these Outside Contractors are capable of (1) protecting the privacy of your personally identifiable information consistent with this Privacy Policy, and (2) not using or disclosing your personally identifiable information for any purpose other than providing us with the products or services for which we contracted or as required by law.
Sale of Business.
We reserve the right to transfer information to a third party in connection with a sale, merger or other transfer of all or substantially all of the assets of Yodelay or any of its Corporate Affiliates (as defined below), or that portion of Yodelay or any of its Corporate Affiliates to which the Service relates, or in connection with a strategic investment by a third party in Yodelay, or in the event that we discontinue our business or file a petition or have filed against us a petition in bankruptcy, reorganization or similar proceeding, provided that the third party agrees to adhere to the terms of this Privacy Policy.
Affiliates.
We may disclose information (including personally identifiable information) about you to our Corporate Affiliates. For purposes of this Privacy Policy, "Corporate Affiliate" means any person or entity which directly or indirectly controls, is controlled by or is under common control with Yodelay, whether by ownership or otherwise; and “control” means possessing, directly or indirectly, the power to direct or cause the direction of the management, policies or operations of an entity, whether through ownership of fifty percent (50%) or more of the voting securities, by contract or otherwise. Any information relating to you that we provide to our Corporate Affiliates will be treated by those Corporate Affiliates in accordance with the terms of this Privacy Policy.
DOES THIS PRIVACY POLICY APPLY WHEN I LINK TO OTHER WEBSITES OR SERVICES?
Our Service may provide you with access to other websites and services. Please be aware that we are not responsible for the privacy practices of any websites or services other than the Service. HOW ARE DO NOT TRACK SIGNALS TREATED?
The term “Do Not Track” refers to a HTTP header offered by certain web browsers to request that websites refrain from tracking the user. We may revise this Privacy Policy from time to time. Such restrictions do not apply where you provide your authorized agent with power of attorney pursuant to California Probate Code sections 4121 to 4130. Yodelay does not sell any Personal Information. Yodelay will not discriminate against you for exercising your privacy rights conferred by the CCPA.
